German Environmental Code

For various reasons, a codification of environmental law – preferably rather on an European than on a national level – would make sense. The repeatedly failed German Environmental Code (UGB), however, was rather a paper tiger: Friendliness to investors and civil society; legal certainty; avoiding a race to the bottom concerning environmental standards; and thereby consolidated environmental protection had required three things: as many complete rules as possible; as least Länder-deviations as possible; and integration of as many parts of environmental law as possible. Neither the UGB nor some recently, instead of the UGB, created water and nature protection codes attain but one of these three objectives. The question `UGB or not UGB' only had minor environmental relevance.
